What happens at empty intersections?

In chapter 50.3 of the book it says that the "inLinks" are chosen with a probability proportional to their capacity. Does this only apply, when there are queues on all links?

I guess, what my question really is, is this: If i have one link with an extremely high capacity, but no agents on it, and one link with a relatively small capacity and agents on it, will the agents on the small link still have some waiting time on average?

yes, this is applicable to all (in-)links which offers vehicles ready to move to next link. You can confirm this here.
